Applicable laws (choice of venue and forum)

Use of this website shall in all respects be governed by the laws of the state of New South Wales, Australia, regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that the New South Wales courts located in Australia, New South Wales, shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts.

Deliveries

By placing an order on www.luxxlocal.com.au you acknowledge that you have read, understood and agreed to be bound by all the terms and conditions as listed within this agreement. These terms and conditions may be changed or amended and/or updated at any time. In the highly unlikely event that your delivery is not received, please contact us as soon as possible so we can investigate your order. The price stated for each gift does not include Delivery. This is a separate charge which is selected at checkout based on location and weight/volume of the gift. Luxx Local uses personal deliveries for Australia Post for delivery of orders of Luxx Local by the selected date requested. However, this is not always possible due to unforeseen circumstances that are beyond our control. You agree when placing an order that if a delivery is in transit and a late delivery occurs this does not entitle you to cancel an order. Luxx Local will hand deliver hampers to certain suburbs, within the local LGA. These suburbs are Manyana, Bendalong, Fishermans Paradise, Lake Conjola, Yatte Yattah, Milton, Narrawallee, Mollymook, Ulladulla, Kings Point, Dolphin Point, Burrill Lake, Lake Tabourie, Termeil, Bawley Point and Kioloa. In the event you have provided us a wrong address we are more than willing to redeliver/redirect your order with an additional $15.00 delivery charge. If the recipient is not at the delivery address that you have given, the courier will do the best to leave the parcel/gift providing it is safe to do so, or your order/parcel will be taken to the local Australian Post Office. Hampers containing alcohol will not be left. We cannot deliver to some remote rural locations including Christmas Island, Magnetic Island, Kangaroo Island, Rottnest Island and other Islands. Fruit and vegetable/perishable hampers should be ordered 24hrs before expected delivery and these hampers will be hand delivered by a Luxx Local staff member. Said hampers are only available for delivery to the suburbs listed above in 'local LGA' unless otherwise approved by Lixx Local.

Delivery Times

Weekday deliveries are made during business hours (9am To 5.30pm) to business addresses and occasionally until 7pm to residential addresses and hospitals. Weekends are not available. Hampers cannot be delivered on a Saturday or Sunday, or public holidays without a special request. Orders received over the weekend or on a public holiday will be dispatched on Monday or next available working day. Regretfully, we are unable to guarantee times of delivery. Unable to guarantee delivery day when update/or change of address occurs may take additional 1-2days. Some Hospitals do not allow deliveries directly to the room or ward by the couriers and rely on volunteers to deliver the goods to the patients. We cannot take responsibility for delivery if there are delays getting it to the patient but happy to contact the hospital on your behalf. As soon at it is delivered to the front desk, volunteer station of receiving area (depending on hospital procedure), our system will flag this as delivered but it may mean that it still needs to be delivered to the patient internally via hospital staff and volunteers. Deliveries on items requiring multiple days for delivery may be delivered earlier than anticipated due to 3rd party courier schedules. 

Holiday Deliveries

Demand upon our resources during holiday periods is very high and we are unable to offer timed deliveries of any kind during certain periods. Holiday Delivery requests are all accepted and delivered, but must be ordered by a certain date/time to guarantee delivery for the requested day. If orders are placed before the cut off date/time, orders will be delivered as requested. The Luxx Local team will ensure plenty of notice will be provided to make the customer aware of these dates before they arrive.

Substitution Policy

Even though the utmost care is taken to make sure that what you order at www.luxxlocal.com.au If specific product components become temporarily unavailable, other components of greater or equal value may be substituted to facilitate delivery of your order on time. In the case where a specific product is unavailable within the given time frame of delivery, substitutions may be made for products of the same or greater value. Different products may be used if the overall effect of the hamper is maintained. In the event that the substitution constitutes a major departure from the content or style of the advertised product, we will make every effort to reach you by phone and email to seek your approval before proceeding. All substitutions will be made with appropriate products to the same value or greater than the original order.

Photography

Please note that for photographic purposes some hampers & may have been featured with additional props, e.g. wine glasses to display wine Please refer to the list of contents on the product page to review full hamper/Item contents.

Cancellations

If you choose to cancel or alter your order once it has been placed we are more than happy to offer a full refund back to your credit card (less a $15.00 administration charge). We are unable to offer a refund on the day of dispatch as the gifts will already be on the way. Any order that has been placed/dispatched and is in transit for delivery and is cancelled you will be charged the delivery fee of $15.00.

Refunds

The special requirements and concerns surrounding your order are unique. For that reason, we ask that you to send photos to email luxxlocal@outlook.com and call our Support Centre on 0415 169 878 to discuss any queries or concerns you may have in relation to the items you have sent or received. A number of resolutions may be available to you and are subject to your particular situation. 

What if I’m not happy with my order? We want your online experience with us to be easy and enjoyable. If for any reason you are unhappy with your order once received, please notify Luxx Local within 24 hours so we can investigate your order. We will endeavour to get back to you within 24 hours. Complaints Procedures

All complaints should be made to Luxx Local via our e-mail at luxxlocal@outlook.com will acknowledge all complaints within 5 working days and investigate the complaint immediately. We will keep you fully informed during the investigation and endeavour to resolve all disputes within a few days. If necessary a full refund or exchange will be offered. If you have any comments on how to we may improve our service please do not hesitate to contact us on our e-mail address above. In the event that you are not totally satisfied that your delivery does not constitute the correct quality or value as compared to the displayed product you ordered from our website, please notify us by email at: luxxlocal@outlook.com Phone Within Australia: +61 415 169 878. Please be advised that this should be done within 24 hours from receipt of goods, so that Luxx Local can arrange for a return and a credit refund on your purchase. Unfortunately we may be unable to assist with quality related complaints on perishables if they are not made within this specified time period. Please note: We do not accept responsibility for the theft, loss or damage of the goods once they have been delivered to the address you have provided.
